Research Series – “An Equitable Approach to Mitigation” with Prof. Maharaj

The doctrine of mitigation is an extremely longstanding feature of the jurisprudence governing the assessment of damages in contract and tort going back nearly 200 years.  Its pedigree notwithstanding, it is not particularly well explained or understood.  The work on mitigation that I will discuss remedies this by considering and explaining the doctrine in light of its apparent function, and by more accurately casting mitigation as an equitable doctrine that intercedes in the assessment of damages at common law (or under statute) to prevent under or overcompensation.
