What is Consent for Sex?

consentConsent means saying yes to something provided that you understand what you’re consenting to, and you are freely able to make that choice. It is a voluntary, sober, mutual and honest verbal agreement. It is a process that must be agreed upon each step of the way. Consent is never implied and can never be assumed.

What is legal sex?

Sex is legal when both people consent to it and are mentally and legally able to consent. If you are drunk, are on drugs, or feel scared or forced to have sex you are unable to consent.

  • Any one under the age of 12 cannot consent under any circumstance. This is sexual assault
  • A 12 or 13 year old can consent to sex with someone less than 2 years older (and person isn’t in position of authority or exploitative relationship)
  • A 14 or 15 year old can consent to sex with someone less than 5 years older (and person isn’t in position of authority or exploitative relationship)
  • 16-18 year olds are able to consent except when partner is in position of authority

Your Rights

  • You have the right to chose what sexual activities you are willing to do, and with whom.
  • You have the right to choose whichever birth control you prefer and are safe for you, you don’t need permission.
  • A woman of any age has the right to choose to avoid a pregnancy, or end a pregnancy. Her personal consent is all that matters.
  • You have the right to change your mind about sex at any time.

 Consent cannot be give if…

  • You are scared of the person who is asking you to consent
  • You feel pressure that if you don’t consent the person will reject or hurt you
  • The other person holds a position of power or trust (ex. Teacher, doctor, police officer)
  • You are drunk or on drugs when giving consent
