Dr. Lorne Neudorf’s recent full length article on the Supreme Court of Canada has been published by Oxford University Press in the Statute Law Review. The article, entitled “Taking Comparative Law Seriously: Rethinking the Supreme Court of Canada’s Modern Approach to Statutory Interpretation” examines five years of Supreme Court cases to consider the extent to which the Supreme Court uses foreign law in interpreting Canadian legislation. It concludes by proposing a new approach to strengthen the value and legitimacy of using foreign law.
