Dr. Lorne Neudorf, Assistant Professor in the Faculty of Law, had an op-ed published in The Financial Post this week, detailing his concern over the lack of scrutiny over ministerial lawmaking powers.

In the opinion piece, “The dangers of Trudeau’s ‘government by cabinet’,” Neudorf writes: “At his swearing-in ceremony in Rideau Hall, Prime Minister Justin Trudeau proclaimed a return to government by cabinet as opposed to government by a prime minister. While this is a positive development likely to lead to better consensus-based decision-making, one important aspect of cabinet rule has worryingly received little attention: the scrutiny of ministerial lawmaking powers.”

Neudorf goes on to explain that while laws made by ministers are merely called “regulations”, those regulations have the full force of the law behind them, albeit without the safeguards provided by the parliamentary process.
