Law professors cited by Ontario Court of Appeal

The Ontario Court of Appeal recently cited a paper co-authored by TRU Law Professors Chris Hunt and Mica Rankin, titled R. v. Spencer: Anonymity, the Rule of Law, and the Shrivelling of the Biographical Core (2015) 61 McGill L. J. 193. In its decision, Elementary Teachers Federation of Ontario v. York Regional District School Board, 2022 ONCA 476, the court held that two teachers had a reasonable expectation of privacy in relation to the contents of an online log which referenced their workplace concerns that was accessed by the school principal without their permission. Citing Hunt’s and Rankin’s argument, the court determined that the contents of the log could be considered private even though it was not biographical core information.
